Purpose

The purpose of this privacy policy is to let users of the Underground Asset Register (the “Platform”) know when we (Digital Built Aotearoa Foundation) collect personal information and what we do with it. We do not use, share or transfer personal information except as set out in this policy.

If there is any conflict between this Privacy Policy and the End User Licence Agreement then the End User Licence Agreement prevails.

Collection, storage and use

Your disclosure of personal information

You may decide to disclose personal information to us by providing identifying information when:

  • obtaining a logon to the Platform;
  • subscribing to Platform updates by email;
  • adding utility network information or other material to the Platform; or
  • seeking information from or via the Platform or from us directly.

This information will be accessible by certain members of our staff. To the extent that it forms part of material that you have submitted to be published on the Platform, it may also be viewable by authorised and authenticated users of the Platform.

You may choose to not disclose personal information to us. You should be aware however that it may mean we are restricted or prevented from providing access to the Platform to you.

Your use of the Platform may also generate an access trail for audit and security purposes.

Through your use of the Platform, we may also collect information from you about someone else where you have authorised us to do so or where the information if publicly available. If you provide us with personal information about someone else, you must ensure that you are authorised to disclose that information to us and that, without us taking any further steps required by applicable data protection or privacy laws, we may collect, use and disclose such information for the purposes described in this Privacy Policy.

Holding of information

Personal information that you provide will be held by us and by our outsourced server provider who uses cloud hosted infrastructure located in New Zealand and you consent to us and our server provider storing your personal information.

We will only use personal information provided to us or generated by the Platform for the following purposes:

  • to provide services offered by this Platform;
  • to enable Platform users to collaborate with and contact data providers and network utility operators;
  • to administer and evaluate this Platform;
  • to monitor Platform access and security; and
  • to communicate with users of the Platform.

In this clause, “Platform” includes any public version of an underground asset register that we may release.

Sharing of personal information

We will share the underground asset data with any authenticated user that wishes to access the data. These users will be able to view the data on the Platform and may have the ability to download data from the Platform and/or consume the data through a web service data feed, subject to the security levels (please refer to the End User Licence Agreement). We may also share the data with other government agencies and non-government organisations and the data may be made available on a public version of an underground asset register. The network utility data and site records data may contain names, email addresses and phone numbers for relevant contact personnel for organisations that use the Platform.

Statistical information and cookies

Statistical information

We may collect statistical information about your use of the Platform to help us analyse usage of, and improve, the Platform. This information includes:

  • users’ IP addresses;
  • users’ search parameters;
  • pages accessed on the Platform;
  • links that are clicked on;
  • date and time of Platform visits;
  • previous visited site;
  • users’ operating systems; and
  • browsers used when accessing the Platform.

Cookies

This Platform generates cookies for logged in users. The cookies, which can be found on your computer, are named nzuar.org.nz.

Records and disclosure statement

Public Records, Official Information and Parliament

Personal and other information disclosed to us on or via the Platform may constitute public records and be retained to the extent required by the Public Records Act 2005. We may also be required to disclose such information under the Official Information Act 1982 or Local Government Official Information and Meetings Act 1987. We will not disclose such information under the Official Information Act or Local Government Official Information and Meetings Act 1987, without first taking reasonable steps to consult the relevant data provider.

Updates

We reserve the right to change this Privacy Policy at any time. The amended Privacy Policy will be considered effective as soon as it is posted to the Platform.  If you continue to access and use our Platform, you will be considered to have accepted the amended Privacy Policy.
